Mr. VanPuymbrouck was recently retained by the owner of a food processing factory that suffered a catastrophic explosion involving industrial equipment, which involved complex business interruption and lost profits damages and complex product liability issues involving Mechanical Engineering, Metallurgical, and Chemical engineering issues.Before retaining Mr. VanPuymbrouck, the client approached the equipment provider in the hope that a mutual investigation of the incident could lead to a resolution.The equipment provider, however, had different ideas and immediately began to blame the food processing factory for the failure of its equipment.Thus, the equipment manufacturer refused to provide any compensation to the food processing factory, telling them to “go pound sand.”Mr. VanPuymbrouck was retained, and he immediately assembled world-class experts to assist in the evaluation of the incident, including all of the physical evidence.Over the course of 18 months, Mr. VanPuymbrouck systematically took the equipment manufacturer apart, if you will, by taking deposition after deposition of its key personnel and extracting telling admissions about defects in the equipment that led to the explosion.Punctuated by a week in which Mr. VanPuymbrouck deposed all six of the defendants’ experts ranging from PHD’s in metallurgy, mechanical engineering, economics, and warnings all of whom made material concessions, Mr. VanPuymbrouck was able to resolve the matter to the client’s complete satisfaction.
