Darren VanPuymbrouck is dedicated to delivering excellence and value to a wide array of clients from companies of all sizes to individuals. As first-chair, he has successfully tried dozens of complex commercial and tort-based cases, and argued appeals across the country. He also manages nation-wide, mass and class actions, setting trial strategy and litigation management and advises clients on risk-avoidance and product and workplace safety issues.
Recently, he successfully completed a month-long jury trial as first-chair in Ocean County New Jersey, resulting one of the largest verdict in that county. Before that he successfully tried a lawsuit that resulted in one of the largest verdicts of that year, and which was listed among the top 100 verdicts nationally.
Darren recently represented an LLC member in a multi-million dollar lawsuit who was sued by his fellow LLC members. They alleged breach of fiduciary duty and fraud, seeking millions because the LLC lost ownership of a significant real estate asset. Darren quickly and effectively researched and drafted an airtight motion to dismiss, invoking several novel arguments under Illinois law, including a bankruptcy filing by the plaintiffs that barred their ability to pursue a claim not disclosed in the bankruptcy petition. Over the strenuous opposition of the plaintiffs, the Court dismissed the lawsuit, saving his client years of costly litigation and the emotional drain of such combat.
Darren also advises, counsels and conducts investigations for domestic and international clients on product safety, food safety and regulations, litigation exposure, and loss avoidance and in managing client’s compliance with the Consumer Product Safety Improvement Act and in responding to CPSC investigations.
Darren’s practice focuses on product liability, toxic torts, food safety and regulations, insurance coverage disputes, contract negotiations, including UCC “battle of the forms” matters, consumer class actions, and RICO and professional liability disputes. He also has significant experience in a wide range of complex commercial litigation matters through trial and appeal, including in commodity brokerage and trading and post-closing M & A disputes, Fair Housing Act Claims and real estate development disputes, and in many others areas. He additionally has a particular focus and international reputation in the investigation and litigation of catastrophic fire and explosion matters.
